Article 1 – Definitions
For the purposes of these Terms & Conditions:
WonderTCG, we, us or Seller means Wonderflow Records, trading under the name WonderTCG, registered with the Dutch Chamber of Commerce under number 98616048.
Customer, Consumer or you means a natural person purchasing products from WonderTCG for purposes outside their trade, business, craft or profession.
Website means https://wondertcg.store.
Product means any product offered for sale by WonderTCG, including new and sealed Pokémon Trading Card Game products, booster packs, booster boxes, collection boxes, Elite Trainer Boxes and other sealed trading card products.
Order means an order for Products placed through the Website.
Agreement means the distance sales agreement concluded between WonderTCG and the Consumer following acceptance of an Order.
Pre-order means an Order for a Product that has not yet been released or is not yet available for immediate dispatch.
Business Day means Monday to Friday, excluding official public holidays in the Netherlands.
Article 2 – About WonderTCG
WonderTCG is a trading name and business activity of Wonderflow Records, a business registered in the Netherlands.
WonderTCG specialises in the sale of new and sealed Pokémon Trading Card Game products and related sealed trading card products.
The Agreement is entered into with Wonderflow Records trading as WonderTCG.
WonderTCG currently supplies Products to consumers within Europe.
These Terms & Conditions apply to all offers, Orders, Pre-orders, Agreements and deliveries made through the Website unless expressly agreed otherwise in writing.
Any departure from these Terms & Conditions is valid only when expressly agreed in writing by WonderTCG.
Nothing in these Terms & Conditions is intended to exclude or restrict any mandatory rights granted to Consumers under applicable consumer protection legislation.
Article 3 – Product Information
WonderTCG makes reasonable efforts to ensure that Product descriptions, photographs, prices, availability and other information displayed on the Website are accurate.
Product photographs are provided for illustrative purposes. Packaging, promotional markings, security seals, artwork or other minor details may differ from photographs where manufacturers alter Product presentation.
Such differences do not constitute a defect where the Product supplied is substantially the Product described and ordered.
WonderTCG sells new and sealed Products unless expressly stated otherwise on the relevant Product page.
The contents of sealed trading card Products are determined by their manufacturer. WonderTCG has no control over, and does not guarantee:
a. which individual cards will be contained within a pack or box;
b. the rarity of any cards;
c. the monetary or resale value of cards contained within a Product;
d. the presence of any particular card, artwork, variant or rarity unless expressly guaranteed by the manufacturer; or
e. any financial return, investment value or future market value of a Product or its contents.
Trading card products contain randomised contents. Purchasing a sealed Product does not guarantee that the Consumer will receive any particular card or level of rarity.
Minor manufacturing imperfections to outer packaging which do not affect the authenticity, contents or reasonable use of the Product will not automatically constitute a lack of conformity.
Nothing in this Article affects the Consumer’s statutory rights where a Product is damaged, defective, incorrectly supplied or otherwise fails to conform to the Agreement.
Article 4 – Offers and Formation of the Agreement
Products displayed on the Website constitute an invitation to place an Order and do not by themselves constitute a binding offer by WonderTCG.
The Consumer places an Order by completing the checkout process and submitting the Order for payment.
The Consumer is responsible for ensuring that the information entered during checkout is complete and accurate.
After an Order is placed, WonderTCG will normally send an electronic acknowledgement or confirmation.
An Agreement is concluded when WonderTCG accepts the Order.
WonderTCG may refuse or cancel an Order before dispatch where there is a reasonable basis to do so, including:
a. an obvious pricing or Product information error;
b. suspected fraud or unauthorised payment;
c. the Product being unavailable;
d. an incorrect stock level;
e. restrictions affecting delivery to the Consumer’s location;
f. a supplier or manufacturer cancelling or materially reducing availability; or
g. circumstances which reasonably prevent WonderTCG from fulfilling the Order.
Where an Order that has already been paid for is cancelled by WonderTCG, the amount paid for the cancelled Product will be refunded using the original payment method unless otherwise agreed with the Consumer.
Article 5 – Prices and Payment
Unless clearly stated otherwise, prices displayed to Consumers include Dutch VAT or other VAT applicable to the transaction in accordance with applicable tax rules.
Delivery charges and any other additional charges will be displayed before the Consumer confirms the Order.
The total amount payable will be shown during checkout.
Payment must normally be made in full when the Order is placed.
Pre-orders must also be paid in full at the time the Pre-order is placed unless the relevant Product page expressly states otherwise.
WonderTCG may offer different payment methods from time to time. The payment methods available to the Consumer will be shown during checkout.
WonderTCG is not required to dispatch an Order until payment has been successfully received or authorised.
In the event of an obvious pricing error, WonderTCG is not required to supply the Product at the incorrect price where the Consumer knew or could reasonably have recognised that the price was incorrect. In such circumstances, WonderTCG will contact the Consumer and offer the choice of paying the correct price or cancelling the affected Product for a full refund.
Article 6 – Pre-orders
Products marked as Pre-orders are Products that are expected to become available at a future date.
Any release date or expected dispatch date shown for a Pre-order is an estimate based on information available to WonderTCG at that time.
Release dates may be changed by manufacturers, distributors or other parties within the supply chain.
A delay to a release date does not automatically cancel a Pre-order.
Where a Pre-order is materially delayed, WonderTCG will endeavour to inform the Consumer as soon as reasonably possible.
Unless the Pre-order has already entered the dispatch process, the Consumer may request cancellation of a Pre-order before dispatch and will receive a refund of the amount paid for the cancelled Pre-order.
The Consumer’s statutory rights of withdrawal following delivery remain unaffected.
Product allocations
Trading card products, particularly new Pokémon releases, may be subject to manufacturer or distributor allocations.
Placing a Pre-order does not create an absolute guarantee that WonderTCG will receive the full quantity requested from its suppliers.
If WonderTCG receives fewer units than expected, WonderTCG may reasonably reduce or cancel affected Pre-orders.
WonderTCG will use objective and reasonable criteria when dealing with allocation shortages.
WonderTCG will not substitute a different Product without the Consumer’s agreement.
Where WonderTCG cannot fulfil all or part of a paid Pre-order because of an allocation reduction or cancellation by a supplier or manufacturer, the Consumer will receive a full refund for the affected Product or quantity.
WonderTCG is not responsible for speculative resale losses, anticipated increases in market value or other investment-related losses arising solely because a Pre-order Product is delayed or unavailable, except where liability cannot lawfully be excluded.
Article 7 – Delivery
WonderTCG currently uses DHL for the shipment of Orders unless another delivery method is expressly stated.
Available delivery methods, delivery charges and estimated delivery times will be displayed during checkout where applicable.
Delivery times stated on the Website are estimates unless WonderTCG expressly agrees a specific binding delivery date.
WonderTCG will process and dispatch Orders with reasonable care and within the time required by applicable law.
Where a Product cannot be delivered within the agreed period, WonderTCG will inform the Consumer.
Nothing in these Terms limits the Consumer’s statutory rights relating to delayed delivery.
The Consumer must provide a complete and correct delivery address.
WonderTCG is not responsible for additional costs or delays caused by incorrect or incomplete address information supplied by the Consumer, except to the extent that WonderTCG itself caused or contributed to the error.
Where an Order is returned to WonderTCG because the Consumer provided an incorrect address, refused delivery without exercising a statutory right, or failed to collect the shipment, WonderTCG may charge reasonable actual costs associated with redelivery where permitted by law.
Article 8 – Risk During Delivery
For Consumers, the risk of loss or damage to the Product remains with WonderTCG until the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Product.
The appointment of DHL or another carrier by WonderTCG does not transfer transport risk to the Consumer before delivery.
If a parcel appears visibly damaged upon delivery, the Consumer is encouraged to photograph the parcel and packaging and notify WonderTCG as soon as reasonably possible.
Failure to report visible transport damage immediately does not remove mandatory statutory rights.
In the case of a suspected lost DHL shipment, the Consumer should contact WonderTCG so that an investigation can be opened with the carrier.
Article 9 – Right of Withdrawal
A Consumer purchasing through the Website generally has the statutory right to withdraw from the Agreement without giving a reason within 14 days.
For the purchase of goods, the withdrawal period normally begins on the day after the Consumer, or a third party designated by the Consumer other than the carrier, receives the Product.
Where multiple Products forming one Order are delivered separately, the statutory period will be calculated in accordance with applicable consumer law.
To exercise the right of withdrawal, the Consumer must clearly inform WonderTCG of the decision to withdraw before the withdrawal period expires.
The Consumer may do so through:
a. the cancellation or withdrawal functionality provided on the Website;
b. the statutory/model withdrawal form made available by WonderTCG;
c. email to wondertcgeurope@gmail.com; or
d. another clear written statement communicating the decision to withdraw.
After exercising the right of withdrawal, the Consumer must return the Product within the statutory return period.
Article 10 – Sealed Trading Card Products and Returns
Pokémon and other trading card Products sold by WonderTCG are collectible products whose condition and factory sealing may significantly affect their retail and resale value.
Consumers may inspect a Product to the extent reasonably necessary to establish its nature, characteristics and functioning in the same way that they would reasonably be able to inspect it in a physical shop.
Opening a booster pack, booster box, Elite Trainer Box, collection box or comparable sealed trading card Product may go substantially beyond what is necessary to inspect the Product because opening the packaging:
a. reveals randomised contents;
b. permanently breaks the manufacturer’s seal;
c. may make the Product impossible to resell as a new sealed Product; and
d. may substantially reduce its commercial value.
WonderTCG does not state that merely opening packaging automatically removes a statutory right of withdrawal where applicable law provides otherwise.
However, where a Consumer has handled a Product beyond what is necessary to establish its nature, characteristics and functioning, the Consumer may be responsible for the resulting reduction in value to the extent permitted by applicable law.
In the case of opened sealed trading card Products, that reduction in value may be substantial and, depending on the circumstances, may amount to most or potentially all of the Product’s retail value.
Consumers wishing to preserve the full return value of a Product are therefore strongly advised not to:
a. break manufacturer seals;
b. remove shrink wrap;
c. open booster packs;
d. open or remove sealed internal components;
e. damage Product packaging; or
f. otherwise alter the condition in which the Product was delivered.
This Article does not restrict rights relating to Products that were already defective, incorrectly supplied, damaged before risk passed to the Consumer or otherwise non-conforming when supplied.
Article 11 – Return Costs and Refunds
Unless otherwise required by law, the Consumer bears the direct cost of returning a Product when exercising the statutory right of withdrawal.
WonderTCG will bear reasonable return costs where the Product was incorrectly supplied, defective, damaged before delivery or otherwise non-conforming and WonderTCG is legally responsible for those costs.
Returned Products should be adequately packaged to prevent damage during return transport.
When the Consumer withdraws from the entire Agreement, WonderTCG will refund payments received for the relevant Order, including the cost of the least expensive standard delivery method offered by WonderTCG, where required by law.
Additional delivery costs resulting from the Consumer choosing a more expensive delivery method than the standard method offered by WonderTCG do not have to be refunded except where required by law.
Refunds will be made within the period required by applicable law.
WonderTCG may withhold reimbursement until it has received the returned Products or the Consumer has supplied adequate evidence that the Products have been returned, whichever occurs first, where permitted by law.
Refunds will normally be made using the same payment method used for the original transaction unless the Consumer expressly agrees otherwise.
No fee will be charged solely for receiving a statutory refund.
Article 12 – Incorrect, Damaged or Missing Products
The Consumer should check an Order within a reasonable period after delivery.
If an Order contains an incorrect Product, is incomplete, arrives damaged or appears to have been tampered with during transport, the Consumer should contact WonderTCG as soon as reasonably possible.
Consumers are encouraged to provide photographs of:
a. the shipping box;
b. shipping label;
c. protective packaging;
d. damaged Product; and
e. any visible signs of tampering,
where relevant to the complaint.
Requiring supporting information does not remove any mandatory statutory consumer rights.
Where a complaint is valid, WonderTCG will provide an appropriate remedy in accordance with applicable consumer law, which may include replacement, repair where appropriate, price reduction or refund.
Article 13 – Statutory Guarantee and Conformity
All Products supplied by WonderTCG must conform to the Agreement and meet the standards that Consumers are legally entitled to expect.
The Consumer has statutory conformity rights under Dutch consumer law and, where applicable, mandatory European consumer protection legislation.
These statutory rights are not limited to a fixed one-year commercial warranty.
A Product must possess the characteristics and quality that a Consumer may reasonably expect based on, among other things:
a. the Product description;
b. its price;
c. statements made by WonderTCG or the manufacturer where legally relevant;
d. the Product’s nature; and
e. other relevant circumstances.
The statutory guarantee does not cover problems caused solely by:
a. misuse;
b. improper storage by the Consumer;
c. accidental damage occurring after delivery;
d. unauthorised alteration;
e. normal deterioration reasonably expected from the Product; or
f. damage caused by the Consumer.
The random contents of a correctly supplied and authentic sealed trading card Product do not constitute a defect merely because the Consumer does not receive a desired card or rarity.
A Product is not defective merely because individual cards contained within sealed manufacturer packaging have lower commercial or resale value than expected.
Nothing in this Article limits any rights that cannot legally be excluded or restricted.
Article 14 – Complaints
Consumers may submit complaints to:
WonderTCG / Wonderflow Records
Grote Hout- of Koningsweg 12
1951 GS Velsen-Noord
The Netherlands
Email: wondertcgeurope@gmail.com
Telephone: +31 6 3451 6834
A complaint should contain sufficient information for WonderTCG to identify the Order and understand the issue.
WonderTCG will endeavour to acknowledge and resolve complaints within a reasonable period.
Where additional investigation is required, WonderTCG will endeavour to keep the Consumer informed.
Consumers retain all rights available to them under applicable consumer protection legislation regardless of WonderTCG’s internal complaints procedure.
Article 15 – Retention of Title
Ownership of Products remains with WonderTCG until the Consumer has paid the full amount due under the Agreement.
This retention of title does not affect the rules governing the transfer of risk to Consumers during delivery.
Article 16 – Fraud, Abuse and Order Restrictions
WonderTCG reserves the right to take reasonable measures to prevent fraud, abuse, automated purchasing or other activity that could harm WonderTCG or its customers.
WonderTCG may impose reasonable purchase limits on Products, particularly limited-release and allocated Products.
WonderTCG may cancel Orders placed in circumvention of clearly communicated purchase limits.
WonderTCG may refuse an Order where there are reasonable grounds to suspect:
a. payment fraud;
b. use of stolen payment information;
c. abuse of promotional offers;
d. deliberate circumvention of Product limits; or
e. other unlawful activity.
Any action under this Article must comply with applicable consumer and anti-discrimination law.
Article 17 – Force Majeure
WonderTCG will not be liable for a failure or delay in performing an obligation to the extent that performance is prevented by circumstances outside its reasonable control.
Such circumstances may include, where genuinely applicable:
a. natural disasters;
b. fire or flooding;
c. war, terrorism or civil unrest;
d. widespread transport disruption;
e. government restrictions;
f. widespread telecommunications or power failures;
g. industrial action outside WonderTCG’s reasonable control; or
h. serious disruption affecting manufacturers, distributors or logistics providers.
Supplier shortages, reduced allocations or manufacturing delays may affect availability of trading card Products. WonderTCG will take reasonable steps to minimise the effect on Consumers.
Where performance is temporarily prevented, the affected obligation may be suspended for the duration of the event.
If WonderTCG ultimately cannot supply a Product, the Consumer will be entitled to cancellation and reimbursement as required by applicable law.
Nothing in this Article removes statutory rights relating to non-delivery, refunds or termination.
Article 18 – Liability
WonderTCG is responsible for loss or damage to the extent required by applicable law.
WonderTCG does not exclude or restrict liability where doing so would be unlawful.
In particular, nothing in these Terms excludes liability arising from intentional misconduct, fraud or any other liability which may not legally be excluded.
To the extent permitted by law, WonderTCG is not responsible for speculative or purely investment-related losses relating to:
a. changes in collectible market prices;
b. future resale values;
c. grading outcomes;
d. card rarity;
e. secondary market demand; or
f. anticipated profits from reselling Products.
Trading cards and sealed trading card Products should not be regarded as guaranteed financial investments. Their market value may rise or fall independently of WonderTCG.
This Article does not restrict the Consumer’s rights where WonderTCG fails to fulfil its legal or contractual obligations.
Article 19 – Intellectual Property
Unless otherwise stated, the Website, its original text, layout, branding, graphics and other content created for WonderTCG are owned by or licensed to Wonderflow Records.
Such content may not be reproduced, distributed or commercially exploited without prior permission except where permitted by law.
Pokémon, Pokémon Trading Card Game, Pokémon character names, logos, card artwork and other associated intellectual property are owned by their respective rights holders.
Unless expressly stated otherwise, WonderTCG is an independent retailer and does not claim ownership of third-party trademarks, Product artwork or other intellectual property belonging to manufacturers or rights holders.
References to third-party brands are used only as reasonably necessary to identify and describe Products offered for sale.
Article 20 – Privacy and Personal Data
WonderTCG processes personal data in connection with Orders, payments, delivery, customer service and operation of the Website.
Personal data will be processed in accordance with applicable privacy legislation, including the General Data Protection Regulation where applicable.
Further information about the processing of personal data should be set out in WonderTCG’s separate Privacy Policy.
These Terms & Conditions do not replace the Privacy Policy or Cookie Policy.
Article 21 – Changes to These Terms
WonderTCG may amend these Terms & Conditions from time to time, including to reflect changes to legislation, business practices, delivery arrangements or the Website.
The Terms applicable to an individual Order are normally the Terms that were in effect when that Order was placed.
Changes to these Terms will not retrospectively remove or reduce statutory rights relating to an existing Agreement.
The current version of the Terms will be published on the Website together with its effective date.
Article 22 – Severability
If any provision of these Terms is found by a competent court or authority to be invalid, unenforceable or unlawful, that provision will be interpreted or limited to the minimum extent necessary where possible.
The remaining provisions will continue in effect.
An invalid provision will not affect any mandatory statutory rights of the Consumer.
Article 23 – Governing Law
Wonderflow Records and WonderTCG are established and registered in the Netherlands.
All Agreements entered into through WonderTCG and these Terms & Conditions are governed by Dutch law.
Dutch law shall therefore be the primary governing law governing the Agreement between WonderTCG and the Consumer.
However, where WonderTCG directs its commercial activities to Consumers resident elsewhere in Europe, the choice of Dutch law will not deprive such Consumers of mandatory consumer protection provisions that apply to them under applicable European or national conflict-of-law rules and which cannot legally be excluded by agreement.
Nothing in these Terms is intended to circumvent or remove mandatory rights granted to European Consumers.
To the extent permitted by applicable law, disputes will be submitted to the competent courts of the Netherlands.
Where mandatory consumer law gives a Consumer the right to bring proceedings before another competent court, this Article does not remove that right.
The United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent that it could otherwise apply, is excluded.
Article 24 – Priority of Consumer Law
These Terms & Conditions are intended to operate in accordance with Dutch and applicable European consumer law.
If any provision of these Terms conflicts with a mandatory statutory consumer right, the mandatory statutory provision takes precedence to the extent of that conflict.
The invalidity or inapplicability of one provision does not invalidate the remaining Terms.
